New granny flat rules NZ (2026)

Up to 70 m² without a building consent

  • From 15 January 2026, a new detached, single-storey granny flat of up to 70 m² can be built without a building consent, if it meets the conditions in Schedule 1A of the Building Act. MBIE's second version of the guidance took effect on 8 October 2026.
  • You still need a PIM (project information memorandum) from council before work starts. It flags anything on your site that affects the build.
  • Licensed people do the work. Building work by or under a Licensed Building Practitioner; plumbing, drainlaying and electrical by licensed trades.
  • 2 m clear of every boundary and of other buildings, simple compliant construction, and no natural hazard on the land.
  • Within 20 working days of finishing, notify council with the plans, Records of Work and certificates, and pay any development contributions.
  • Resource consent is separate. The national standard permits one minor unit on most eligible sites, but your district plan's rules still apply.

Two-minute check

Could your granny flat skip the building consent?

  1. 1. Is it a new, detached, single-storey building?
  2. 2. Is the floor area 70 m² or less?
  3. 3. Will it sit at least 2 m from every boundary and from other buildings?
  4. 4. Is there already a home on the same property?
  5. 5. Will licensed people do or supervise the building, plumbing, drainage and electrical work?
  6. 6. Is the site clear of natural hazards the council has flagged (flooding, slips, coastal erosion)?

Answer all six to see your result. Nothing is sent anywhere.

How to choose

What to compare before you sign

  1. 1

Compare the total, not the base price

Ask each builder for a site-specific price with transport, foundations and connections in it. The unit is often only 55 to 70 percent of what you will spend.

Show builders with a published price
  2. 2

Read what the 'from' price includes

Base spec, GST, a kitchen, a bathroom, decking, curtains, heat pump. Two '$150k' flats can be $40k apart once you add the gaps.

  3. 3

    Pick a build model

Turnkey means one company is responsible for everything. Kitset is cheaper but you manage the trades. Site-built suits sloping or tight sections a truck cannot reach.

    Show turnkey builders
  4. 4

Ask who handles the council paperwork

Under the 2026 exemption someone still has to get the PIM, collect the Records of Work and file the completion notice. Make it the builder, in writing.

Show builders with 70 m² designs
  5. 5

    Check the warranty and memberships

A Master Build or Halo 10-year guarantee covers you if the builder fails to finish. Membership of Master Builders or NZ Certified Builders is a reasonable first filter.

    Show master builders members
  6. 6

Get the lead time and payment schedule

Yard slots book out. Avoid paying more than about 10 to 20 percent before construction starts, and tie the rest to stages you can see.

Show builders quoting 8 weeks or less
  7. 7

    Walk through a show home

Photos flatter small spaces. Stand in the bathroom, open the wardrobe, look at how the joins are finished.

How we check listings

We started from 163 businesses that advertise granny flats, cabins or minor dwellings in New Zealand and kept the 143 whose websites are live. Every card shows the date we last read the builder's site.

Prices

Prices are the lowest figure each builder advertises, with the GST basis they state. Where we could not tell what a number referred to, we left the price off. Builders change prices often, so confirm before you budget.

Independence

No builder pays to be listed, and the order is never for sale. If we add paid placements or referral links later, they will be labelled, and they will not change the order of the directory.

Granny flat questions, answered

Do I need a building consent for a granny flat in NZ?
Not since 15 January 2026, if it is a new detached single-storey building of 70 m² or less, at least 2 m from boundaries and other buildings, on a site that already has a home, built or supervised by licensed people, and clear of natural hazards. You still need a project information memorandum (PIM) from council before you start, and you must notify council within 20 working days of finishing.
What is the maximum size of a consent-free granny flat?
70 m² of floor area, single storey. That is why so many builders now sell 69 to 70 m² two-bedroom plans. Anything bigger goes through a normal building consent.
How much does a 2-bedroom granny flat cost in NZ?
Published 60 to 70 m² two-bedroom units sit roughly between $145k and $299k for the unit alone. Delivery, foundations, services, council fees and development contributions typically add another $40k to $100k. The calculator on this page breaks that down for your site.
How long does it take to build a granny flat?
Factory-built and transportable units are usually 8 to 16 weeks in the yard once plans are signed off, plus 2 to 6 weeks of site work. A site-built granny flat is more like 4 to 6 months. Add 4 to 8 weeks if you need a building consent.
Can I rent out my granny flat?
Usually yes, as a minor residential unit, but the tenancy must meet the Healthy Homes standards and your district plan may limit the size or require it to share the driveway and services with the main house. Tell your insurer and your bank.
Can I put a tiny house on wheels in my backyard?
A genuinely mobile tiny home on a road-legal trailer is usually treated as a vehicle, not a building. Councils look at whether it is effectively permanent: once it is plumbed in, skirted and has not moved for months, it can be treated as a building and need consent.
Do I also need a resource consent?
It depends on your district plan. The national standard for minor residential units permits one granny flat on most residential and rural sites if it meets the standard's conditions, but rules on site coverage, setbacks and earthworks still apply. Ask your council for a pre-application check.
What is included in an advertised 'from' price?
Usually just the unit, built and ready in the builder's yard, often in the base spec. Transport, crane, foundations, connections to power, water and drains, council fees, decks and steps are normally extra. Check whether the price includes GST: on this page we show the basis each builder states.
Kitset or transportable: which is cheaper?
A kitset is cheaper to buy, but you or your builder still put it together on site, and restricted work must be supervised by an LBP. Once labour is added, the gap to a transportable unit is often smaller than the sticker prices suggest. Transportables trade a higher unit price for a faster, more predictable build.
Will a granny flat add value to my property?
A permitted, self-contained minor unit generally adds value and rental income. A flat that skipped the PIM or the completion notice can do the opposite when you sell, because the buyer's lawyer will find it on the LIM. Keep every Record of Work and certificate.
